Shipping & returns

1.1 When ordering the Goods, you may choose the method of delivery of the Goods, i.e. use a courier (third party) delivery service.

1.2 You undertake to specify the exact place of delivery of the Goods when you choose the delivery service at the time of ordering.

1.3 You undertake to collect the Goods yourself or, at the time of placing your order, to designate a person to collect the Goods. In the event that you (or another person specified) are unable to collect the Goods and the Goods are delivered to the address specified and on the basis of the other details provided by the Buyer, you shall not be entitled to make any claim against the Company in respect of the delivery of the Goods to the wrong person.

1.4 The delivery charge shall be based on the size of the order placed by you and the place of delivery:

1.4.1 An additional transportation charge is applicable for delivery of the Goods to Curonian Spit.

1.5 When you wish the Goods to be delivered outside Lithuania, the terms of delivery of the order shall be agreed by separate agreement.

1.6 If you place an order before 12 noon on weekdays, the Company or a third party will deliver the Goods within 1-3 working days. In the event of a failure or shortage of Goods, the Company shall promptly notify you of the possibility of a longer delivery period and, if you are satisfied, the Company shall proceed with the delivery of the order. In the event that you are not satisfied with the Company's longer delivery time, the order placed shall be cancelled and the amount paid by you shall be refunded in accordance with the procedures set out in these Terms.

1.7 In all cases, the Company shall be exempt from liability for failure to meet the delivery deadlines for the Goods if the Goods are not delivered to you or are not delivered on time through no fault of yours or due to circumstances beyond the Company's control.

1.8 The Company shall not be liable for any act, omission or event from the time the Goods are handed over to the delivery service provider (courier). In the event that the packaging you have received is externally defective, you must inform the courier at the time of delivery of the Goods.

1.9 At the time of delivery of the Goods to you or your authorised person, you (or your authorised person) must inspect the condition of the consignment and the condition of the Goods(s) together with the Seller or the courier who has delivered the Goods to you, and must sign the consignment handover and acceptance document. Once you have signed the handover acceptance document, the consignment and the Goods shall be deemed to have been handed over to you in good quality, and there shall be no defects in the Goods attributable to defects other than manufacturing defects and no inconsistencies in the delivery of the Goods(s).

1.10 If you notice that the packaging of the delivered consignment is damaged, the Goods(s) are damaged and/or the Goods(s) are not in the correct condition, you must note this in the handover document and, in the presence of the Seller or its courier (a third party), draw up a free-form certificate of the damage/mismatch of the consignment and/or the Goods(s). Failure to do so shall exempt the Company from liability to you for any damage to the Goods, quality, assembly, packaging not noted by you in the delivery document.

RETURN AND EXCHANGE OF GOODS

2.1 In the event of the return of faulty Goods (where the foodstuffs are damaged or expired on the date of delivery), the Company undertakes to take back the faulty Goods and replace them with similar Goods. In the event that the Company does not have equivalent Goods, the Company undertakes to refund the money paid by you for the Goods.

2.2 Any defective Goods or error must be notified to info@ajsokoladas.lt on the same calendar day that the Goods are delivered.

2.3 When returning or exchanging Goods purchased at the E-Store, you will be asked to complete the provided Return or Exchange Form.

2.4 Depending on the type of Goods offered by the Company, you shall have the right to complain to the Company on the same calendar day following the delivery of the Goods, in respect of any discrepancies that are subsequently discovered and recorded. In this case, the Company undertakes to investigate the claim within 1 (one) working day and, if the claim is justified, to replace the Goods with Goods that meet the quality requirements or to refund the money paid for the Goods.

 2.5 In all cases, money for returned Goods shall be transferred by payment order and only to the payer's bank account.

2.6 No conditions for the return of Goods shall apply:

2.6.1 Where the Goods are perishable or have a short shelf life;

2.6.2 Where the packaged goods have been unpacked after delivery and are unsuitable for return for health or hygiene reasons.
